These Terms and Conditions govern all travel bookings, tour packages, and services offered by HimTrails. By confirming a booking or making a payment — whether through our website, WhatsApp, or in person — you agree to these terms in full. Please read them carefully before finalising your trip.

HimTrails is a travel company based in Shimla, Himachal Pradesh, India, operating under the laws of the Republic of India.

Booking Confirmation

A booking is considered confirmed only after HimTrails has received the advance payment and issued a written confirmation — via WhatsApp, email, or document.

Bookings are subject to availability at the time of confirmation. Verbal discussions or itinerary sharing does not constitute a confirmed booking. HimTrails reserves the right to decline a booking at its discretion before confirmation.

Payment Terms

An advance payment — typically 25% to 50% of the total package cost —
is required at the time of booking confirmation. The balance must be
cleared before the trip departure date, as communicated by the
HimTrails team.

Package prices are quoted at the time of booking and are subject to
change due to fuel price revisions, government levies, seasonal
surcharges, or factors beyond our control. Any confirmed booking will
honour the price agreed at confirmation.

All payments are to be made via the methods communicated by HimTrails
— bank transfer, UPI, or authorised payment gateway. Cash payments
must be acknowledged in writing by HimTrails to be valid.

Cancellation and Refund Policy

HimTrails follows a transparent, slab-based cancellation structure in accordance with India’s Consumer Protection Act 2019.

Itinerary Changes

Himalayan travel is subject to conditions beyond any operator’s control — snowfall, landslides, road closures, permit restrictions, and weather. HimTrails reserves the right to modify hotels, sightseeing stops, routes, or activity schedules without prior notice when safety or operational necessity requires it.

In such cases, HimTrails will arrange comparable alternatives at no additional cost to the traveller. No refund or compensation will be issued for modifications made due to force majeure events including but not limited to natural calamities, government orders, road blockades, strikes, or extreme weather.

Itinerary changes initiated by the traveller after departure are subject to availability and may incur additional costs.

Transportation

All vehicles are provided strictly as per the itinerary — point-to-point transfers and sightseeing as listed. Vehicles are not on a disposal basis and will not be available for unscheduled detours or personal errands unless separately arranged and confirmed in writing.

Air conditioning is limited or unavailable in high-altitude mountain regions including Spiti Valley, Lahaul, Leh Ladakh, and mountain roads above 2,500 metres. This is standard across all mountain operators and is not a service deficiency.

Vehicle upgrades or changes may occur due to operational requirements. HimTrails will ensure a comparable or better vehicle class is provided in such cases.

Hotel and Accommodation

Standard hotel check-in time is 12:00 noon and check-out is 11:00 AM, as per individual hotel policy. Early check-in and late check-out are subject to hotel availability and may carry additional charges.

Hotels listed in itineraries are indicative. HimTrails reserves the right to substitute with comparable properties in the same category without prior notice, should the listed property become unavailable due to unforeseen circumstances.

Room allocation — standard, deluxe, or premium — is as confirmed in the booking. Requests for specific room types or floors are subject to hotel policy and cannot be guaranteed.

Health, Fitness and Altitude Advisory

Himachal Pradesh and Ladakh include destinations above 3,500 metres — including Spiti Valley, Kaza, Kunzum Pass, Khardung La, and various Leh Ladakh circuits. Travel to these areas carries inherent risks associated with high altitude including Acute Mountain Sickness (AMS), breathlessness, and reduced physical capacity.

Travellers are strongly advised to:

  • Consult a physician before booking if they have heart conditions, respiratory issues, high blood pressure, epilepsy, or any chronic medical condition.
  • Carry prescribed altitude medication such as Diamox, as recommended by their doctor.
  • Disclose any pre-existing medical conditions to the HimTrails team before booking confirmation.

HimTrails does not provide medical advice and holds no liability for health incidents arising during a trip. Travellers undertake all adventure activities and high-altitude travel at their own risk.

Travel Insurance

HimTrails strongly recommends that all travellers purchase comprehensive travel insurance covering trip cancellation, medical emergencies, evacuation, and personal accident before departure. HimTrails does not provide travel insurance as part of any package unless explicitly stated in the itinerary.

In remote Himalayan regions, helicopter evacuation may be the only option in a medical emergency. The cost of such evacuation is the sole responsibility of the traveller or their insurer.

Permits and Documentation

Certain destinations — including Spiti Valley, Lahaul, Kinnaur, Rohtang Pass, and Leh Ladakh — require Inner Line Permits or Protected Area Permits issued by the relevant state authority.

Where HimTrails has agreed to arrange permits on behalf of the traveller, this will be confirmed in writing at the time of booking. Unless explicitly included, travellers are responsible for obtaining their own permits.

All travellers must carry a valid government-issued photo ID — Aadhaar card, passport, driving licence, or voter ID — throughout the trip. HimTrails holds no responsibility for denied entry due to missing documentation.

Traveller Conduct and Responsibilities

Travellers are expected to behave respectfully towards fellow passengers, hotel staff, drivers, guides, and local communities at all times. Any form of verbal abuse, physical misconduct, intoxicated behaviour, or harassment will result in immediate
termination of the tour without refund.

Travellers are responsible for the safety of their personal belongings, documents, and valuables at all times. HimTrails holds no liability for loss, theft, or damage to personal property during the trip.

Travellers must adhere to all local laws, environmental regulations, and restricted area rules. Any illegal activity — including possession of prohibited substances — is the sole responsibility of the traveller.

Unused Services

No refund or credit will be issued for services included in a package that remain unused due to the traveller’s choice — including meals skipped, sightseeing points not visited, or activities not participated in. Package pricing reflects the full planned itinerary regardless of individual usage.

Intellectual Property

All content on himtrails.in — including text, itineraries, photographs, videos, logos, and brand elements — is the exclusive property of HimTrails. Reproduction, distribution, or commercial use of any content without written permission from HimTrails is strictly
prohibited.

Jurisdiction and Dispute Resolution

These Terms and Conditions are governed by the laws of India. Any disputes arising from a booking or service provided by HimTrails shall be subject to the exclusive jurisdiction of the courts in Shimla, Himachal Pradesh.

In the event of a dispute, both parties agree to first attempt resolution through direct communication. HimTrails’ decision on operational matters — including itinerary changes made for safety reasons — shall be considered final.

Is my HimTrails booking 100% non-refundable?

Can HimTrails change my hotel or itinerary after I have booked?

Yes, in specific situations — primarily when road conditions, weather, or safety concerns make the original plan unviable. This is common in Himalayan travel. We ensure a comparable alternative at no extra cost and communicate all changes via WhatsApp as early as possible.

What happens if a road to Spiti or Ladakh is blocked during my trip?

HimTrails will reroute the itinerary wherever possible. If a destination becomes completely inaccessible, we offer an alternative of comparable value. Refunds are not applicable for force majeure situations — this is standard across all mountain travel operators in India.

Are permits included in my HimTrails package?

It depends on your specific package. Inner Line Permits for Spiti, Kinnaur, and Ladakh are included in most of our packages and will be clearly stated in your booking confirmation. If not included, our team will guide you on how to obtain them before departure.

Can I travel with HimTrails if I have a heart condition or blood pressure issue?

You must consult your physician before booking any high-altitude Himalayan trip — especially for destinations above 3,500 metres like Spiti, Leh, and Ladakh. Please disclose any medical condition to our team at the time of enquiry so we can advise on suitable itineraries.

What ID proof do I need to carry on a HimTrails trip?

A valid government-issued photo ID is mandatory throughout the trip — Aadhaar card, passport, driving licence, or voter ID. For inner line permit areas like Spiti and Ladakh, passport-size photos may also be required. Our team will inform you of specific documentation requirements in your pre-trip briefing.

Is travel insurance mandatory for HimTrails trips?

Not mandatory but strongly recommended — especially for Spiti Valley, Leh Ladakh, and any trekking itineraries. In remote areas, helicopter evacuation can cost ₹1.5 to ₹4 lakh or more, and that cost falls entirely on the traveller without insurance.

Which court handles disputes with HimTrails?

Any legal disputes fall under the jurisdiction of courts in Shimla, Himachal Pradesh, India. We always prefer resolving issues directly — contact us first on WhatsApp or email and our team will work to find a fair solution.
